화사한 봄날(Beautiful Spring)(이하 "회사")이 운영하는 수영의 모든 것(Everything Swimming) 서비스(이하 "서비스")의 이용에 관한 사항을 규정합니다.

제1조 (목적)

이 약관은 회사가 제공하는 웹사이트, 모바일 애플리케이션, 및 관련 서비스의 이용 조건과 절차, 회사와 이용자 간의 권리·의무 및 책임 사항을 규정함을 목적으로 합니다.

제2조 (서비스의 내용)

회사가 제공하는 서비스는 다음과 같습니다.

  1. 아티클: 수영 관련 지식 콘텐츠 제공
  2. 용어사전: 수영 용어 검색 및 학습
  3. 가이드: 단계별 수영 학습 콘텐츠 제공
  4. 기타: 회사가 추가로 개발하거나 제휴를 통해 제공하는 일체의 서비스

서비스는 무료 콘텐츠와 유료 콘텐츠(인앱구매 또는 유료 앱)로 구분될 수 있으며, 유료 콘텐츠의 가격과 범위는 별도로 고지합니다.

제3조 (콘텐츠 제작 방식 및 면책)

1. AI 기술 활용 안내

본 서비스의 콘텐츠는 AI(인공지능) 기술을 활용하여 작성되며, 수영 전문가(콘텐츠 에디터)의 검수를 거쳐 제공됩니다. 회사는 콘텐츠의 정확성과 품질을 위해 노력하지만, AI 기술의 특성상 일부 정보에 오류가 포함될 수 있습니다.

2. 의학적 조언 면책

본 서비스에서 제공하는 콘텐츠는 일반적인 수영 지식 및 정보를 목적으로 하며, 의학적·치료적 조언을 대체하지 않습니다. 건강 상태에 관한 결정은 반드시 의료 전문가와 상담하시기 바랍니다.

3. 운동 중 부상 면책

본 서비스에서 제공하는 훈련법, 드릴, 운동 프로그램 등은 참고 자료로서 제공되며, 이를 실행하여 발생하는 부상이나 사고에 대해 회사는 책임을 지지 않습니다. 이용자는 자신의 건강 상태와 수준에 맞게 운동을 실시해야 합니다.

제4조 (저작권 및 지적재산권)

  1. 서비스 내 콘텐츠(텍스트, 이미지, 디자인, 로고, 데이터 구조 등)에 대한 저작권 및 지적재산권은 회사에 귀속됩니다.
  2. 이용자는 서비스를 통해 얻은 콘텐츠를 개인적·비상업적 용도로만 사용할 수 있으며, 회사의 사전 서면 동의 없이 복제, 배포, 전송, 출판, 방송 등에 이용할 수 없습니다.
  3. 이용자가 서비스 내에 게시한 콘텐츠(댓글, 리뷰 등)의 저작권은 해당 이용자에게 귀속되며, 회사는 서비스 운영 목적 범위 내에서 이를 사용할 수 있습니다.

제5조 (광고 게재)

  1. 회사는 서비스 운영을 위해 웹사이트 및 애플리케이션 내에 제3자 광고를 게재할 수 있습니다.
  2. 광고를 통해 이동하는 제3자 웹사이트 또는 서비스의 내용에 대해 회사는 책임을 지지 않습니다.
  3. 광고 게재에 따른 개인정보 처리는 개인정보처리방침에 따릅니다.

제6조 (유료 서비스 및 결제)

  1. 유료 콘텐츠 또는 프리미엄 기능이 제공되는 경우, 가격·범위·결제 방법은 해당 서비스 페이지 또는 앱 스토어에서 사전 고지합니다.
  2. 인앱구매의 경우, 각 앱 스토어(Apple App Store, Google Play Store)의 결제 및 환불 정책이 적용됩니다.
  3. 유료 앱의 경우, 구매 후 환불은 각 앱 스토어의 환불 정책에 따릅니다.
  4. 회사 측 사유로 서비스가 중단되는 경우, 미사용분에 대한 환불 절차를 별도 안내합니다.

제7조 (이용자의 의무)

이용자는 다음 행위를 하여서는 안 됩니다.

  1. 서비스 콘텐츠의 무단 복제, 배포, 전송, 2차 가공
  2. 서비스의 정상적인 운영을 방해하는 행위
  3. 타인의 개인정보를 도용하거나 침해하는 행위
  4. 회사의 서버 또는 네트워크에 대한 비인가 접근
  5. 기타 관계 법령에 위반되는 행위

제8조 (서비스의 변경 및 중단)

  1. 회사는 서비스의 내용을 변경하거나 중단할 수 있으며, 이 경우 변경 사항을 웹사이트에 공지합니다.
  2. 천재지변, 시스템 장애 등 불가항력으로 인한 서비스 중단에 대해 회사는 책임을 지지 않습니다.

제9조 (분쟁 해결)

  1. 이 약관에 관한 분쟁은 대한민국 법령에 따릅니다.
  2. 서비스 이용과 관련하여 발생한 분쟁에 대해 소송이 제기되는 경우, 회사의 소재지를 관할하는 법원을 전속 관할 법원으로 합니다.

These Terms define the conditions, procedures, rights, obligations, and responsibilities between the Company and users for the use of the website, mobile application, and related services.

Article 2. Description of Service

The Company provides the following services:

  1. Articles: Swimming knowledge content
  2. Glossary: Swimming terminology search and learning
  3. Guides: Step-by-step swimming learning content
  4. Others: Any additional services developed or provided through partnerships

Services may be divided into free and paid content (in-app purchases or paid app). Pricing and scope of paid content will be separately announced.

Article 3. Content Creation & Disclaimers

1. AI Technology Disclosure

Content in this Service is created with the assistance of AI (artificial intelligence) technology and reviewed by a swimming professional (Content Editor). While the Company strives for accuracy and quality, AI-generated content may contain errors due to the nature of the technology.

2. Not Medical Advice

Content is provided for general swimming knowledge and information purposes only and does not constitute medical or therapeutic advice. Consult a healthcare professional for health-related decisions.

3. Exercise at Your Own Risk

Training methods, drills, and exercise programs are provided as reference materials. The Company is not liable for injuries or accidents resulting from their execution. Users must exercise according to their own health condition and skill level.

Article 4. Copyright & Intellectual Property

  1. Copyright and intellectual property rights for all Service content (text, images, design, logos, data structures) belong to the Company.
  2. Users may use content obtained through the Service for personal, non-commercial purposes only. Reproduction, distribution, transmission, publication, or broadcasting without prior written consent is prohibited.
  3. Copyright of user-generated content (comments, reviews) belongs to the respective users. The Company may use such content within the scope of service operation.

Article 5. Advertising

  1. The Company may display third-party advertisements on the website and application for service operation.
  2. The Company is not responsible for the content of third-party websites or services accessed through advertisements.
  3. Personal information processing related to advertising follows the Privacy Policy.

Article 6. Paid Services & Payment

  1. If paid content or premium features are offered, pricing, scope, and payment methods will be announced on the service page or app store.
  2. For in-app purchases, the payment and refund policies of each app store (Apple App Store, Google Play Store) apply.
  3. For paid apps, refunds follow each app store's refund policy.
  4. If the Service is discontinued due to Company-related reasons, refund procedures for unused portions will be separately communicated.

Article 7. User Obligations

Users must not:

  1. Reproduce, distribute, transmit, or create derivative works from Service content without authorization
  2. Interfere with the normal operation of the Service
  3. Misuse or infringe upon others' personal information

  2. The court with jurisdiction over the Company's location shall have exclusive jurisdiction.

Article 10. Amendments

  1. The Company may amend these Terms as necessary. Amended Terms become effective upon announcement on the website.
  2. Users who do not agree to amended Terms may discontinue use of the Service.

Supplementary Provision

These Terms are effective from January 1, 2024.
